1. Agreement to Terms

These Terms and Conditions govern your access to and use of marissaabisaiceja.com, related content, and services offered by Marissa Abisai Ceja. By visiting this website, submitting forms, booking services, or otherwise engaging with this business, you agree to be bound by these Terms.

2. Eligibility and Permitted Use

You agree that you will:

  • use the website for lawful and legitimate purposes only;
  • provide accurate information in forms and communications;
  • not impersonate another person or entity;
  • not interfere with website security, availability, or integrity; and
  • not use the website to harass, threaten, defame, or abuse any person.

We may suspend or deny access for any conduct that violates these Terms or could harm Marissa, clients, or the public.

3. Nature of Services and Important Disclaimers

Services described on this website are educational, wellness-oriented, and transformational in nature. They are not psychotherapy, psychiatry, medical treatment, emergency care, crisis intervention, legal advice, or financial advice.

No specific outcome is promised or guaranteed. Results vary based on individual history, readiness, participation, consistency, and factors beyond our control.

If you believe you may be in danger, in crisis, or experiencing a medical or psychiatric emergency, call 911 (or your local emergency services) immediately.

4. Personal Responsibility and Consent

By participating in services, you acknowledge that you are voluntarily engaging and are responsible for your own decisions, health disclosures, boundaries, and follow-up care. You agree to disclose relevant physical or mental health conditions, contraindications, and medications that could affect safe participation.

You may stop participation at any time. You understand that emotional intensity can arise in somatic and breath-based work, and you assume responsibility for seeking appropriate licensed care when needed.

5. Booking, Payments, Cancellations, and Refunds

Service structures, pricing, scheduling terms, and cancellation/refund conditions may be provided in separate booking communications, proposal documents, invoices, or written agreements. Those written terms are incorporated into these Terms by reference.

Unless otherwise agreed in writing, missed sessions, late cancellations, and schedule changes may be non-refundable or subject to fees.

6. Intellectual Property and Brand Protection

All website content, branding, text, images, video, audio, methods, frameworks, course materials, and downloadable assets are protected by intellectual property laws and remain the sole property of Marissa Abisai Ceja or its licensors.

Without prior written permission, you may not:

  • copy, republish, reproduce, modify, or create derivative works;
  • record, distribute, or resell sessions or proprietary materials;
  • use trademarks, logos, or likeness for commercial or misleading purposes; or
  • misrepresent affiliation, endorsement, or partnership.

7. Prohibited Conduct, Defamation, and Abuse

You agree not to engage in conduct that may harm Marissa or her business, including:

  • defamatory, false, abusive, threatening, or malicious statements;
  • harassment, stalking, intimidation, or discriminatory behavior;
  • attempts to extort, coerce, blackmail, or manipulate business outcomes;
  • fraudulent chargebacks or intentional payment abuse; and
  • unauthorized publication of private communications or materials.

We reserve all legal rights and remedies, including injunctive relief and recovery of damages, costs, and reasonable attorneys' fees where permitted by law.

8. Testimonials and Public Statements

Testimonials and shared client experiences are individual accounts and are not guarantees of outcomes for other people. Public comments about services should be truthful, lawful, and not misleading.

9. Third-Party Services and Links

The website may integrate or link to third-party tools, platforms, or websites. We are not responsible for third-party content, terms, uptime, or privacy practices. Your use of third-party services is at your own risk.

10. Limitation of Liability

To the fullest extent permitted by law, Marissa Abisai Ceja and affiliated parties are not liable for indirect, incidental, consequential, special, punitive, or exemplary damages, including loss of profits, data, goodwill, opportunities, or emotional distress arising from or related to use of the website or services.

To the extent liability cannot be fully disclaimed, total cumulative liability is limited to the amount actually paid by you for the specific service giving rise to the claim in the twelve months before the claim arose.

11. Indemnification

You agree to defend, indemnify, and hold harmless Marissa Abisai Ceja and related parties from claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from your breach of these Terms, misuse of services, unlawful conduct, or violation of rights of any third party.

12. Force Majeure

Marissa is not responsible for delays, interruptions, or failure to perform due to events beyond reasonable control, including natural disasters, public emergencies, travel disruptions, internet outages, platform failures, labor disputes, or governmental actions.

13. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules.

14. Binding Arbitration and Class Action Waiver

Any dispute, claim, or controversy arising out of or relating to these Terms, the website, communications, or services shall be resolved exclusively by final and binding arbitration in California on an individual basis.

You and Marissa each waive the right to a jury trial and waive the right to participate in class, collective, representative, or private attorney general actions, to the fullest extent permitted by law. Arbitration will be administered under commercially reasonable arbitration rules selected by Marissa, unless otherwise required by law.

Either party may seek temporary injunctive relief in a court of competent jurisdiction to prevent immediate or irreparable harm pending arbitration.

15. Severability, Waiver, and Entire Agreement

If any provision of these Terms is found unenforceable, the remaining provisions remain in full force. Failure to enforce any provision is not a waiver. These Terms, together with any written booking or service terms, constitute the entire agreement regarding website and service use.

16. Changes to Terms

We may update these Terms at any time. Updates are effective when posted. Your continued use after updates means you accept the revised Terms.
